Assistant Professor awarded grant for research project in EU law

Graham Butler, Assistant Professor in European Union law at the Department of Law, Aarhus BSS, has been awarded an Assistant Professor Starting Grant by the Aarhus University Research Foundation (AUFF) for his research project, ‘In times of crisis: Access to justice in the European Union’. The research project, commencing in 2018 with Butler as the Principal Investigator (PI), will be funded to the tune of 1,25 million DKK over the next three years.

Access to justice and judicial remedies for individuals and other legal entities invoking European Union law is increasingly coming under greater scrutiny. Both the widening and deepening of Union law has meant that differentiated standards of judicial review have existed over time, and in different policy fields that have Union law components. With the EU being the only supranational system of providing access to justice for individuals through judicial remedy at the time of its creation, the Union and its Court has thus had to self-explore the concept of access to justice, and construe locus standi as being narrow, broad, or somewhere in between.

Ensuring remedies are available to different types of legal actors through judicial review is a long-standing problem in the EU judicial architecture, which has involved the judiciaries of Court of Justice of the European Union, and of national courts within EU Member States. With progression in how legal actors intervene and perform in the present age, Union law is covering an ever-greater number of areas, with each field having its own set of unique characteristics that demand new ways of ensuring judicial protection. By exploring access to justice issues in the widened and deepened field of EU law, this research project, under the direction of Graham Butler, will assess, analyse, and critique the most pressing issues on access to justice in the EU legal order.
